Role of an Israeli Citizenship Lawyer
An Israeli citizenship lawyer is a lawyer who specializes in all pathways to obtaining Israeli citizenship. According to the Citizenship Law of 1952, there are actually six routes through which one can obtain citizenship.
Paths to Obtaining Israeli Citizenship
Citizenship by Descent A person whose at least one parent holds Israeli citizenship is eligible for Israeli citizenship, regardless of their place of birth. Sometimes foreign citizens are eligible for Israeli citizenship without even knowing it.
Citizenship by Birth and Residence in the Country Relevant to those who were in Israeli territory after the establishment of the state and were born there.
Citizenship by Naturalization Any person interested in becoming an Israeli citizen may apply to the Ministry of Interior for citizenship, subject to the following conditions:
1. The person has lived in Israel for at least three of the past five years
2. The person is eligible for permanent residency
3. The person has settled or plans to settle in Israel
4. The person has some knowledge of the Hebrew language
5. The person has renounced any additional citizenship
It is important to note that each of these conditions has its own criteria that must be proven.
Citizenship by Right of Return (for Jews only) Israeli law grants every person of Jewish origin the right to immigrate to Israel with an immigrant visa and obtain citizenship. In fact, the Law of Return not only provides the right to immigrate but also grants actual citizenship. The nearly only caveats are that the applicant must prove their Jewish identity and show that they have no criminal past.
Citizenship by Residence in Israel This citizenship is primarily relevant to Arabs, Druze, and Bedouins. It is granted to those who were within the country’s borders at the end of the War of Independence.
Citizenship by Grant The Minister of Interior has the right to personally grant Israeli citizenship to those whom the State of Israel considers valuable. For example: Righteous Among the Nations, scientists, cultural figures and athletes, those who fought alongside Israel in its wars, and others.
Important Note: Additionally, by virtue of international treaties, the State of Israel grants Israeli citizenship to foreign spouses of Israeli citizens, upon completion of the graduated residency process for couples.
