The Law of Return and Eligibility for Israeli Citizenship
Our office specializes in granting Israeli citizenship to foreigners from around the world, including through the ‘Law of Return’. In general, the Citizenship Law in Israel establishes six pathways for obtaining citizenship in Israel, with the most common path being citizenship by virtue of return
Eligibility under the Law of Return is granted to any Jew who wishes to immigrate to Israel, with immigration to Israel being based on an immigrant visa. The spouse of a Jew or their descendant is also entitled to receive status by virtue of return, and even someone who has converted to Judaism, and whose conversion is recognized, is entitled to the status of a new immigrant.
Challenges in the Citizenship Process
However, in order to receive the status, one must meet the conditions set by law and provide relevant documents, including a certificate of good conduct proving no criminal record and a health certificate. Sometimes, there is difficulty obtaining documents from the relevant country, whether it’s documents proving the applicant’s Judaism or documents proving that the applicant has no criminal record that poses a danger to the public in Israel or any danger to state security. The country of origin of the Israeli citizenship applicant may sometimes create difficulties for various reasons. In many cases where status is requested under the Law of Return by someone who has converted, the Ministry of Interior creates difficulties in accepting the status and does not recognize the conversion performed, its sincerity, or its validity.

We have often succeeded in obtaining new immigrant status for our clients, even when the Ministry of Interior initially refused to grant this status. We have represented many clients who approached us for representation in proceedings with the Ministry of Interior or in appeal proceedings against its decision, and thus we have often managed to change the Ministry of Interior’s decision in the administrative courts as part of an appeal or administrative petition.
