What is the Appeals Tribunal

The Appeals Tribunal is a court for foreigners established as a judicial instance with special authority in immigration matters. Its role is to exercise judicial review over the authorities’ decisions in the areas of citizenship, status, and immigration law.

The Appeals Tribunal operates as an independent court, separate from the District Court or the Ministry of Interior. Its decisions often have significant implications for human rights issues. The Appeals Tribunal operates under the Entry into Israel Law and serves as an appeals body for decisions made by the Population and Immigration Authority regarding entry, residence, and stay in Israel, as well as citizenship matters under this law. The authority to grant residence visas and entry permits to Israel lies with the Population and Immigration Authority, which has been authorized to do so by the Ministry of Interior.

Filing an appeal to the Appeals Tribunal

In case of rejection of an application by the Population and Immigration Authority or the Ministry of Interior, the applicant has the right to file an appeal or request a rehearing. The appeal must be filed immediately within 21 days from the date of rejection. In case of rejection in an internal appeal of the authority, an appeal should be filed with the Appeals Tribunal. Appeals against the authority’s decisions are currently submitted to three Appeals Tribunals in Israel located in Jerusalem, Tel Aviv, and Be’er Sheva, which replace the former appeal committees that used to handle appeals against the authority’s decisions. Appeals against decisions of the Appeals Tribunal can be filed with the District Courts sitting as Administrative Courts.
